FACILITY.
This facility rental agreement (the "Agreement") is entered into by and between the Denver Lodge No. 17 of the Benevolent and Protective Order of Elks of the United States of America (the "Lodge") and (the "Renter") referenced above. Whereas, the Renter desires to temporarily rent, occupy, and make use of the Lodge, and Lodge as owner agrees to such rental, occupation, and use in consideration of certain payments and covenants herein enumerated; Now, therefore, the parties agree to the following terms and conditions:
MEETING HALL.
The Lodge is the owner of a meeting hall located at 2475 West 26th Avenue, Denver, Colorado (the "Hall"). The Hall has a maximum seating capacity. PARKING IS LIMITED. Please do not block entrance or exit doors. Renter, or any of Renter’s guests that park in parking spaces labeled "No Parking" will incur and additional charge of $50 per occurrence. Renter or professional caterers will not be permitted to use the Lodge kitchen facilities without proper approval. All other Lodge equipment usage will be on a permitted basis.
RENTAL PERIOD AND MEMBER USE.
The Renter shall have access to and use of the venue on the time and date stated above for the purpose of hosting the above stated event. Lodge shall provide to access to facility no later or earlier than time stated above.
Rental Fee will be set at the rate stated above, for the duration stated above payable in full, one week before rental date. The Lodge is a membership-based organization; therefore, rental of this facility is not exclusive. The Lodge building, facilities, grounds, and parking lot are always available to our Lodge members, Lodge business and tenants of the Lodge. We cannot guarantee use of parking lot for events.
HALL RENTAL FEE.
- The rental fee for this agreement is stated in the fee section.
- Bar minimums are calculated as a pre-taxed/pre-tip amount.
- If bar sales do not reach the bar minimum, Renter will make up the difference.
- If bar sales exceed the bar minimum, Renter is not liable for additional bar sales.
- A single tab for an event will automatically be charged a minimum of 20% for gratuity. You may tip more but definitely not less than 20%. This tip amount is based on the pre-taxed amount.
- A down payment of $250 is required to secure the request facilities regardless of hall fee or bar minimum. (This fee will be applied to the bar minimum if a bar minimum is requested.)
- The remainder will be due within 7 days of the event date.
- If the request for rental is within 7 days of the event date, full payment will be due upon contract signature.
- Upon arrival to your event, the bartender will add your security deposit of $250 to a credit card that will be put on file for the event.
- This fee will be processed, and you will receive your portion of the security deposit as described below. It is possible that the deposit will be removed prior to processing payment.
- In the event a Renter fails to clean the Hall adequately, Lodge shall apply a part or all of the Deposit for cleaning.
- If cleaning is done by Lodge personnel, Renter will be charged based on their regular hourly rates, including benefits. Lodge reserves the right to hire an outside cleaning service at Renter's sole cost.
- In the event Renter or anyone attending the event for which the Hall is rented, whether invited or otherwise, as Renter’s associates, guests, invitees, contractors, and all other persons whatsoever who enter the venue during the rental period, whether or not such persons did so with Renter’s knowledge or consent, damages or removes any Lodge property, Lodge shall retain part or all of the Deposit as compensation for the damage incurred. If the amount of damage exceeds the amount of the Deposit, Lodge reserves the right to make a claim upon the Renter's insurance and/or to pursue any and all other legal remedies.
- Other than deductions made pursuant to this Section, Lodge shall return Deposit to Renter within thirty (30) days of the date of the rental. If Lodge deducts any amounts from the Deposit, Lodge shall provide Renter with an itemized list of the deductions and the reasons for those deductions.
- Renter shall also be liable to Lodge for any and all legal fees, including reasonable attorney fees, court costs, and other expenses associated with collection.
CANCELLATIONS.
If the Renter cancels the reservation more than thirty (30) days prior to the date of the rental, Lodge shall refund the amount paid by the Renter. If Renter cancels thirty (30) or fewer days before the date of the rental, Renter shall be assessed a $100.00 cancellation fee or up to this amount taken from total deposit fee paid. If the lodge cancels the event, a full refund will be issued or a new date will be agreed upon by Renter and the lodge.
ALCOHOL.
Alcohol is permitted ONLY at events authorized by the Lodge and subject to all rules of the Lodge’s liquor licensing. No outside alcohol is allowed to be brought into the Hall. All Alcohol must be consumed on the Lodge premises subject to lodge liquor licenses. Violations of this clause will result in charge to the Renter of $100 per occurrence.
SECURITY.
The Renter is responsible for the security of all people at the Hall during the event. The Lodge can provide security at an additional cost to the Renter.
INSURANCE. (REQUIRED FOR ALL EVENTS – NO EXCEPTIONS)
The Renter must provide proof of $1 million liability insurance coverage for scheduled event. All insurance shall be at the Renter’s expense. The Lodge shall be included as a "named insured" on the Renter’s insurance policy. If alcohol will be sold or consumed, Renter must provide a copy of a Certificate of Insurance that includes "Host Liquor Liability" (liquor provided but not sold) or "Liquor Liability" (liquor sold on premises), with limits of at least $1 million per occurrence.
